Helping You Navigate Minnesota Child Support Law

In Minnesota, child support payments are based on income and parenting time.

There are three components to child support:

  • Basic support – This is the support that covers food, shelter, clothing, and the child’s basic needs. The amount of support paid is determined by each parent’s income and the amount of time each parent spends with the children. Parenting time is measured by the number of overnights the child spends with the non-custodial parent.
  • Childcare – A calculation needs to be performed to divide the responsibility for childcare expenses.
  • Medical support – This includes monthly medical expenses, insurance premiums, and co-pays.

The Help You Need Now & in the Future

After child support is awarded, it can be modified. The standard for modification is that there has been a substantial change in circumstances that makes the current amount of child support unfair or unreasonable. Changes in income and parenting time tend to be the reasons why support is modified.

However, the change in circumstances has a window of 20% but must be at least $75 per month in either direction. If the change in income is less than 20% and less than $75 per month, then the modification may not be awarded. Talking to our Minneapolis child support lawyer can help you decide what you should do in your case by giving you realistic expectations so you can make informed decisions.
